I hereby request a reservation for the following mare to Jumpin Jak Flash+++//;

The breeding will be used in the 2007 season. Terms of the contract are as follows;

1.) I agree to pay Carlin Arabians a non-refundable booking fee of $250. Please make check payable to Carlin Arabians. $350 will be paid by _______ . All fees will be paid prior to semen shipment or said mare is live covered.

2.) The 2007 breeding fee is $1500/$1000. A 10% discount applies if booked by 1/30/2007. This breeding has been discounted to $600. I understand there will be an additional charge for each collection of semen. I also understand all collection fees are nonrefundable. I also understand a separate Shipped Semen Contract or a Live Cover Contract will be signed before Semen is shipped or said mare is Live Covered.

3.)Mare owner shall not be entitles to a refund of fees. There is a Live Foal Guarantee. Live foal for this agreement, means the foal shall stand and nurse. In the event the foal dies of natural causes before it is 7 days old, mare is entitled to a rebreeding in the same year as the loss of the foal only. Mare owner agrees that stallion and or manager does not make any guarantees as to the quality or conformation of the foal, nor that the foal will be free of any infirmity, conformation, defect, disease, or inherited trait. It is understood that if the mare proves barren, aborts her foal, or if the foal is stillborn, a return privilege will be guaranteed in the following year only, provided proper notification is given. Proper notification, for this agreement, shall be defined as follows: Written certification by a licensed veterinarian within (7) days that the mare has slipped or produced a non-viable foal. Mare owner certifies that such abortion or death did not result from any act or omission of the owner subsequent to the mare being checked in foal. If mare does not conceive a “Live Foal” a $150 handling fee will be required for return breeding in the following year.

4.)I understand all semen collection fees are due prior to shipment or pickup of semen. I understand that the mare owner or veterinarian who is to perform the insemination must contact Carlin Arabians by telephone 48 hrs before semen is to be shipped or delivered. Failure to do so may result in the mare not being bred during that heat cycle. It is essential that communication be established and maintained between the inseminating veterinarian or mare owner and Carlin Arabians. We recommend your veterinarian closely follow said mare’s ovulation cycle by daily palpation throughout her heat so that you know as accurately as possible when your mare actually ovulates.

5.) I understand that the mare owner shall assume all responsibility for the condition of the mare and shall bear all the risk of loss or damage to the mare whether by death, disease, injury or otherwise, and by any cause whatsoever and therefore agrees to hold the stallion owner, Carlin Arabians and it’s affiliates harmless for any and all damages therein. Boarding and related fees: Mare Owner shall pay Carlin Arabians, its successors and assigns, all boarding and related fees and expenses associated with the care and maintenance of the mare The cost of all such fees and expenses shall be based upon the farm’s schedule in effect at the time the respective fee or expense is incurred. Mare Owner hereby acknowledges receipt of the fee schedule in effect and acknowledges the fee schedule may be changed from time to time without notice to Mare Owner.

6.) A veterinary examination and current uterine culture taken when said mare is in heat must show she is is in sound breeding condition and free from infection. This is a condition of service.

7.) If the stallion should die or become unfit for service before said mare produces a live foal, or has not had the opportunity for a rebreed the following year, the remaining stud fee shall be refunded to me by the stallion owner within a reasonable time of receipt of a veterinarian’s certificate stating the mare did not produce a live foal. In the event said mare does not conceive after breeding through 3 heat cycles, an alternate mare, approved by Carlin Arabians may be bred. There is a $50 mare transfer fee. In the event the new mare is not bred in the same year the re-breeding fee will also be required.

8.) This contract is non-transferable. In the event the mare is sold or otherwise disposed of prior to the birth of the foal the “Live Foal Guarantee” will no longer be valid unless specific written consent or assignment is given to me prior to transfer of ownership.

9.) I understand registration, IAHA Sweepstakes nomination, JJF Futurity enrollment of the foal will be the mare owners responsibility. A breeder’s certificate will be issued to mare owner once ALL expenses have been paid in full and upon notification of the birth of the foal. At least 1 picture with copyright release of the foal will be supplied to Carlin Arabians before breeder’s certificate is issued.

10.) This contract shall be governed by the laws of the County of Monterey, California and venue for any action hereunder shall be in Monterey County, California.

11.) I certify that I am sole owner of the mare of have authority to enter into this contract on behalf of the owner(s).

12.)In the event this breeding is not used in 2007 breeding season this contract will be considered null and void unless prior approval by Carlin Arabians is given to mare owner.

13.)When the names mare owner signs and returns this contract to the breeder and the stallion owner signs the contract, the contract will then be a binding contract on both parties, subject to the above terms and conditions. This contract is not valid unless completed in full.
